Major changes to the Right to Work Check process are happening from October 1st 2022 – are you prepared?

The temporary measures brought in at the start of the pandemic to allow Right to Work Checks to be conducted digitally by video call – as opposed to in-person – will end on Friday September 30th.

From Saturday 1st October 2022, you will no longer be able to carry out Right to Work Checks by video call, as has been widely practiced since March 2020. As a reminder, Right to Work checks must be conducted for all employees by all UK organisations, including employees who are British nationals.

From 1st October 2022, Right to Work Checks for British and Irish passport holders can only be undertaken in one of two ways:

  1. In-person, with a manual check of documents.
  2. Digitally, using a Home Office-certified Digital Identity Service Provider (IDSP).

What is a Digital Identity Service Provider (IDSP)?

A Digital Identity Service Provider is a third-party company that carries out identity verification of British and Irish citizens using Identification Document Validation Technology (IDVT).

IDSPs can carry out identity verification to a range of standards or levels of confidence. The Home Office recommends that employers only accept Right to Work Checks via an IDSP that satisfies a minimum of a ‘Medium Level of Confidence’. A list of certified IDSPs can be found on the gov.uk website.

It is not mandatory for you to use a certified provider; you may use a provider not featured in the list of certified IDSPs if you are satisfied that they are able to provide the required checks.

Once a Right to Work Check has been completed via an IDSP, you must then confirm yourself that the photo and biographic information provided by the IDSP output is consistent with the applicant/employee.

Following a successful Right to Work Check, employers must keep a clear copy of the IDSPs Right to Work Check output for that employee on record for the duration of employment, as well as for 2 years after their employment has come to an end.
